Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the StockSense AI mobile application (the "Service") operated by StockSense AI ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using StockSense AI, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

You must be at least 18 years old to use this Service.

2. Description of Service

StockSense AI provides AI-powered stock market analysis including:

• Calculation of pivot points, support, and resistance levels
• Trading recommendations with entry, target, and stop-loss prices
• Risk/reward ratio calculations
• Trading strategies and market insights
• Access to historical stock market data

3. Free Trial and Subscription

3.1 Free Trial

• New users receive ONE (1) free stock analysis
• Free trial is limited to one per user
• Free trial counter persists across sign-ins to prevent abuse
• Creating multiple accounts to access additional free trials is prohibited

3.2 Subscription Terms

• Price: $2.99 USD per month (subject to change)
• Billing: Monthly auto-renewable subscription
• Payment: Charged to your iTunes Account at confirmation of purchase
• Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Renewal Charge: Account will be charged for renewal within 24 hours prior to the end of the current period
• Management: Subscriptions may be managed and auto-renewal may be turned off by going to Account Settings in the App Store after purchase
• Cancellation: Any unused portion of a free trial will be forfeited when you purchase a subscription

3.3 Subscription Benefits

Active subscribers receive:

• Unlimited stock analyses
• AI-powered trading recommendations
• Advanced pivot point calculations
• Priority customer support
• Access to all current and future features during subscription period

4. User Responsibilities

You agree to:

• Provide accurate account information
• Maintain the security of your account credentials
• Use the Service in compliance with all applicable laws
• Not abuse, harass, or harm other users
• Not attempt to bypass subscription or free trial limitations
• Not reverse engineer, decompile, or disassemble the app
• Not use the Service for any illegal or unauthorized purpose
• Conduct your own research before making any investment decisions
• Consult with a licensed financial advisor before trading

5. Investment Risk Acknowledgment

By using StockSense AI, you acknowledge and agree that:

• All investment decisions are made solely by you
• You understand that trading stocks involves risk of loss
• You may lose some or all of your invested capital
• The Service provides analysis based on historical data which may not predict future performance
• Market conditions can change rapidly and unpredictably
• AI-generated recommendations are not guaranteed to be accurate or profitable
• You will not hold StockSense AI liable for any trading losses

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• StockSense AI is provided "AS IS" without warranties of any kind
• We do not guarantee the accuracy, completeness, or timeliness of information
• We are not liable for any trading losses or investment decisions
• We are not liable for any direct, indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the subscription in the past 12 months
• We are not responsible for errors in data provided by third-party services (MarketStack API)

7. Intellectual Property

The Service and its original content, features, and functionality are owned by StockSense AI and are protected by:

• International copyright laws
• Trademark laws
• Other intellectual property rights

You may not copy, modify, distribute, or create derivative works without our express written permission.

8. Account Termination

8.1 Termination by You

• You may cancel your subscription at any time through the App Store
• You may delete your account by contacting support
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months

8.2 Termination by Us

We reserve the right to suspend or terminate your account if you:

• Violate these Terms of Service
• Abuse the free trial system
• Engage in fraudulent activity
• Abuse or harass our staff or other users
• Use the Service for illegal purposes

9. Refund Policy

• All subscription purchases are processed through Apple's App Store
• Refund requests must be made directly to Apple
• We do not control Apple's refund decisions

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

11. Third-Party Services

Our Service uses third-party services:

• MarketStack API: For stock market data (we are not responsible for data accuracy or availability)
• Firebase: For authentication services
• Apple App Store: For subscription management and payments

These services have their own terms and conditions which you also agree to follow.

12. Service Availability

• We strive for 99% uptime but do not guarantee uninterrupted service
• Service may be temporarily unavailable for maintenance
• We may modify or discontinue features at any time
• Stock data depends on third-party API availability
• Analysis processing may take 30-90 seconds depending on server load

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of changes by:

• Updating the "Last Updated" date
• Posting the new Terms in the app
• Sending you a notification (for material changes)

Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

• Any disputes will first be attempted to resolve informally by contacting us
• If informal resolution fails, disputes will be resolved through binding arbitration
• You waive your right to participate in class action lawsuits

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and StockSense AI regarding the Service.
